Our web hosting TOS(Terms Of Service)
In ordering a hosting account from SonnetUK, you acknowledge that you have read, understand, and agree to fully abide by our Terms of Service as listed below and Acceptable Use Policy.
Definitions & Preamble
- The following definitions apply to this Terms of Service agreement:
- "We", "us", "our", "the company", "Sonnet" and "SonnetUK" refer to SonnetUK LTD, representing also Sonnet Design and Sonnet Hosting.
- "You", "your", "customer" and "client" refer to the person or company ordering the services or any other party acting on the customer's behalf.
- "Server" refers to the computer server equipment operated by us for provision of services.
- "Services" and "service" refers to web hosting, email provision, customer support and any other service or facility provided by us to you.
- "Account" refers to the area on the server we allocate for your use.
- This agreement shall be governed by and construed in accordance with English law and you hereby submit to the non-exclusive jurisdiction of the English courts.
- Headings are included in this agreement for convenience only and shall not affect the construction or interpretation of this agreement.
Acceptable Use Policy
Billing & Payment
- All SonnetUK hosting accounts are set up on a pre-pay basis.
- SonnetUK reserves the right to change the prices of any of its services at any time.
- All payments will be made in UK Pound (£) Sterling.
- We accept the following payment methods:
- Debit and credit card transactions are carried out by WorldPay on our behalf. All payments through WorldPay are made in UK Pound Sterling, with any currency conversions being made by the cardholder's bank or lender.
- We also accept payment by personal or business cheque, Nochex, BACS/bank transfer/standing order and direct deposit. These payment methods are only available to persons resident in the UK with a UK Pounds Sterling bank account.
- We also accept payment by PayPal, in UK Pound Sterling ONLY. We may, by arrangement and entirely at our discretion, accept payment in US Dollars or Euros via PayPal.
- If you pay by personal or business cheque and your cheque is returned by the bank as unpaid for any reason, you will be charged a "returned cheque" fee of £30 to cover our costs.
- There will be a £30 fee to cover our expenses in the event of an unnecessary chargeback being made on a card payment processed by WorldPay.
- Payment is due monthly or yearly from the date on which the account is first billed. The customer will be automatically charged or invoiced unless we have received a cancellation request through our customer account area of our billing system or via email to billing@sonnetuk.net at least 5 days before the next payment anniversary, and we have confirmed the cancellation with the customer.
- Customers agree that they are liable for any extra charges that their account may incur, including but not limited to additional bandwidth usage and extra diskspace usage.
- Without prejudice to our other rights and remedies under this Terms of Service agreement, if any amount payable is not paid on or before the anniversary or due date, SonnetUK shall be entitled to suspend the account in question. If payment is still not forthcoming after 14 days, we reserve the right to completely terminate the account, and remove all account data from our servers.
- We will not be held liable for any bank charges or administration costs accrued by you in providing payment to us.
Cancellation, Termination and Refunds
- SonnetUK reserves the right to terminate any customer's account at any time without prior notification if the account is in breach of this Terms of Service agreement and/or our Acceptable Usage Policy. No refund will be given in such a situation.
- A customer can choose to cancel their account at any time. Customers submitting cancellation requests within the first 14 days of their account being activated will have their full payment refunded, minus any exempted add-ons or other non-refundable charges. This is our 14 day money back guarantee.
- Customers requesting cancellation of monthly hosting plans requested outside of the first 14 days will not receive a refund. Where payment has been made yearly we may, at our discretion, issue a pro-rated refund of any full months remaining, based on the monthly price of the appropriate plan.
- Cancellation requests must be made through the customer account area of the billing system or via email to billing@sonnetuk.net at least 5 days prior to the next billing date. Cancellations must be confirmed by SonnetUK before the account will cease to be billed.
Service Availability
- We shall use reasonable endeavours to make available to you at all times the servers and the services we offer, but we shall not, in any event, be liable for interruptions of service or downtime of the servers.
- SonnetUK shall not be held responsible for any delays or failure to perform due to internet, network, data centre and equipment problems and/or failures and/or other acts outside of our reasonable control.
Backups
- SonnetUK makes backups of all accounts on our servers daily, weekly and monthly.
- No guarantee of availability or integrity of these backups is given or implied by us, and we encourage customers to maintain their own backups, which are easily made via the control panel.
Limitation of Liability
- In no event shall SonnetUK be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.
- All conditions, terms, representations and warranties relating to the services supplied under this Terms of Service agreement, whether imposed by statute or operation of law or otherwise, that are not expressly stated in this Terms of Service agreement and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded, subject always to the following: Nothing in this Terms of Service agreement shall exclude our liability for death or personal injury resulting from our negligence.
- Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the services shall be limited to the charges paid by you in respect of the services which are the subject of any such claim.
- In any event no claim shall be brought unless you have notified us of the claim within one year of it occurring.
Indemnification
- You agree to indemnify us and keep us indemnified and hold us harmless from and against any breach by you of this Terms of Service agreement or our Acceptable Usage Policy, and any claim brought against us by a third party resulting directly or indirectly from the provision of services by us to you and your use of the services and the servers including, without limitation, all claims, actions, proceedings, losses, liabilities, demands, damages, costs, and expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by us in consequences of your breach or non-observance of this Terms of Service agreement and/or our Acceptable Use Policy.
- You agree that this indemnification extends to all aspects of your account, including but not limited to website content and domain name selection.
Changes to Terms of Service
- SonnetUK reserves the right to change this Terms of Service agreement and our Acceptable Use Policy at any time and without notice. However, notification of changes will usually be posted on SonnetUK.info and/or our customer forums in advance.
- We recommend that customers review this Terms of Service, the Acceptable Use Policy and other policy documents regularly.
IN ORDERING HOSTING SERVICES FROM SONNETUK LTD, YOU SIGNIFY YOU HAVE READ, UNDERSTOOD AND AGREE TO COMPLY WITH OUR WEB HOSTING TERMS OF SERVICE AND ACCEPTABLE USE POLICY.
